About RTA Portal Behaviour Committee

The RTA Portal Co Behaviour Committee made up of claimant and compensator representatives was formed to assist with the resolution of behavioural issues arising from use of the Portal.

Since March 2011 it has reviewed and responded to Portal user feedback where behaviour issues may arise regarding, for example, but not limited to: inappropriate use of Article 75; claims submitted without retainers; inappropriate use of Interim Settlement Packs; extensions of Time without Agreement.

Portal Co takes any suspected mis-use of the Portal seriously and whilst reviewing the findings of the three month pilot will be engaging with the user community and industry regulators, with whom it is already in discussion regarding reporting procedures related to behavioural issues. Portal Co urges all user organisations to ensure that staff fully understand the requirements of the MoJ Protocol and how to use the Portal to support adherence to the MoJ Protocol guidelines and gain maximum cost and efficiency benefits. Completing forms

The Behaviour Committee have rejected a number of forms due to them not meeting the requirements of the Behaviour Committee Policy.

Therefore, it is important users are familiar with the Policy and the steps expected to have been taken prior to submission of the form. The following list is intended to help users in completing the appropriate actions and forms correctly;

  • Forms must be completed by an appropriate senior manager or partner of the firm or organisation;
  • Except in exceptional circumstances, behaviour issues must in the first instance be raised formally in writing with the other party;
  • Copy correspondence relating to the issue and any response is expected to be attached to complaint forms; and
  • Reference should be made to the relevant rules as appropriate.

Report a Behaviour

In the first instance, where a behaviour issue is identified by a Compensator or a Claimant Representative, this should be addressed directly, in writing, with the organisation concerned. Where a satisfactory outcome has not been achieved, the issue is reported to the Behaviour Committee using the RTA Portal Co Behaviour Report Form below. The Behaviour Committee meet on a monthly basis and provide a non biased approach to any behavioural issues that have been submitted, calling on stakeholder guidance if required.

The Behaviour Committee provide general guidance on appropriate behaviour expected by users of the Portal in relation to the issue submitted. Such guidance is not intended to be binding on the parties. The Behaviour Committee consider behaviour issues in the context of the Civil Procedure Rules and Practice Directions, including in particular the Pre-Action Protocol for Low Value Personal Injury Claims, the objectives of that Protocol and the spirit in which it was introduced.
